What is the law on returns and postage

In the UK, returns and postage are governed by the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Here’s an overview of the key rules:

Consumer Rights on Returns

  1. Online Purchases (Distance Selling):
    • Right to Cancel: Consumers have the right to cancel their order within 14 days of receiving the goods. This is often referred to as the “cooling-off period.”
    • Returns: Consumers must return the goods within 14 days of notifying the retailer of the cancellation.
    • Refund: Retailers must provide a refund within 14 days of receiving the returned goods or proof that they’ve been sent back.
  2. In-Store Purchases:
    • There is no automatic legal right to a refund or exchange unless the goods are faulty, not as described, or not fit for purpose. Retailers may offer returns or exchanges as part of their policy, but this is at their discretion.
  3. Exceptions to Returns:
    • Custom-made or personalised items.
    • Perishable goods (e.g., food, flowers).
    • Hygiene-sensitive items (e.g., underwear, swimwear) if unsealed.
    • Digital content once downloaded or accessed.

Faulty Goods

  • Under the Consumer Rights Act 2015, goods must be:
    • Of satisfactory quality.
    • Fit for purpose.
    • As described.

If goods are faulty, the consumer has the right to:

  • A full refund within 30 days of purchase.
  • A repair or replacement after 30 days.
  • A partial refund or replacement if repair or replacement is not possible.

Postage Costs

  1. Cost of Returning Items:
    • If the return is due to the consumer changing their mind, the retailer is not legally required to cover return postage unless stated in their policy.
    • If the goods are faulty, misdescribed, or not fit for purpose, the retailer must cover the return postage costs.
  2. Refunding Initial Delivery Costs:
    • When a consumer cancels their order during the cooling-off period, the retailer must refund the initial delivery costs (standard delivery only, not express delivery).
  3. Responsibility for Lost Returns:
    • Consumers are responsible for ensuring returned goods reach the retailer safely. It is advised to use tracked or insured postage for returns.

Additional Legal Considerations

  1. Clear Return Policies:
    • Retailers must provide clear information about their return policies before the purchase is made, including who bears the cost of returning items.
  2. Digital Goods:
    • The right to cancel does not apply to digital downloads or streaming if the consumer has begun downloading the content and was informed of this limitation before the purchase.
  3. Brexit Impact:
    • EU consumer rights no longer directly apply in the UK, but similar protections remain under UK law.
